FAA SMS Requirements: Implementation Deadlines

The FAA’s Safety Management System (SMS) final rule, published April 26, 2024, expanded mandatory SMS requirements to additional aviation organizations under 14 CFR Part 5. The rule took effect May 28, 2024, establishing specific implementation deadlines based on the type of operation.

FAA SMS Implementation Deadlines

Part 121 — Airlines
Existing certificate holders were required to revise their existing SMS to meet the updated Part 5 requirements by May 28, 2025. New applicants must develop and implement a compliant SMS as part of certification.

Part 135 — Commuter and On-Demand Operators
Existing certificate holders are required to develop and implement an SMS and submit a declaration of compliance to the FAA by May 28, 2027. Applicants with applications submitted or pending on or after May 28, 2024, must develop and implement an SMS as part of the certification process.

Part 91.147 — Commercial Air Tour Operators
Existing operators holding an applicable Letter of Authorization (LOA) before May 28, 2024, must implement an SMS and submit a declaration of compliance by May 28, 2027. New applicants must meet SMS requirements as part of the LOA application process.

Part 21 — Certain Aircraft Design and Manufacturing Organizations
Covered type certificate and production certificate holders are subject to SMS requirements. Existing covered organizations were required to submit an SMS implementation plan by November 28, 2024, and must implement their SMS by May 28, 2027. Separate timelines apply to certain new applicants and licensing arrangements.

Part 145 — Repair Stations
Part 145 repair stations are not included in the 2024 final rule’s general mandatory SMS implementation requirement solely by virtue of holding a Part 145 certificate. They may pursue the FAA’s voluntary SMS program, subject to applicable program requirements.
